FAQ

How does it work?
Once you give us details of your debts we contact the creditors on your behalf to request that they verify the legality of the lending. Upon receipt of specific information we are able to prove or disprove the legality of the contract.

How long does it take?
It does depend on the lender and their speed of response. For the credit card/catalogue debt, we estimate 6 – 12 months. These are only estimates and can vary either way due to the simplicity or complexity of any individual case. The claims could take between 6-24 Months.

Are there alternatives?
Yes - Bankruptcy, IVA or Debt Management. These will all have an adverse effect on your credit file.

Does this affect my Credit File?
If you have a good credit file, we recommend you continue to pay the minimum amount until advised otherwise.

What if I have a Bad Credit File?
In certain cases where adverse credit is already recorded, it would make no difference if minimum payments were not maintained. Our advice is always to maintain your credit file where possible.

Is it Guaranteed?
Nothing is guaranteed. Bear in mind we want our clients to be the bearer of good news not bad news, so we only take cases with a high chance of success.

Could I do this myself?
YES. If you have the knowledge and experience. You can represent yourself in court for Murder..But you would not.

Are there any repercussions?
It is highly unlikely that if we write off a credit card or make a successful claim on a mortgage, that that particular lender will make their services available again. The good news is there are plenty of other lenders.

Can I do this if the Debt has been Sold or Assigned?
It is sometimes easier to deal with a debt collection agency rather than the original lender. It brings other issues into effect that in most cases helps the client’s case and makes it easier to cancel the account.

Would I ever have to go to Court?
If the lender will not negotiate on a case that we know is unenforceable then yes we would issue court proceedings. You would be legally represented in court so do not worry. Most cases are negotiated before the court proceedings.

Although we try to achieve a high level of service and customer care, sometimes things can go wrong and your expectations are not achieved. In these cases we have a complaint procedure which allows us to deal with complaints fairly and promptly.

 

Our procedures follow the Ministry of Justice claims Management Services Regulation Complaint Handling Rules.

 

How to Make a complaint

Handling Complaints

 

We will acknowledge receipt of a complaint within 5 working days. Within 8 weeks of receiving a complaint we will:
1 -  give a final response which deals fully with all issues of the complaint

or 
2 - explain why we are still not in receipt of information which is needed to deal with the issues in question. We would expect to give a time frame at this stage when we would receive information to give a clear final response.

 

We would reserve the right to decline the right to consider a claim where a client has made a claim more than 6 months after becoming aware of any cause for complaint.

 

If for any reason you are dissatisfied with our claims handling procedures after 8 weeks you can refer the complaint to -

The regulator can review the handling of the complaint and give direction on further handling of the complaint. He cannot however determine a complaint or award compensation.
